There are two degrees of kidnapping in Alabama, kidnapping first degree, and kidnapping second degree. Kidnapping First Degree

Kidnapping 1st usually means that the offender has taken someone against their will in order to: demand a ransom; make them a hostage; use them as a shield; or sexually abuse them.  A defense to kidnapping I exists when the offender voluntarily releases the person that was kidnapped prior to the defendant being captured.

As a Class A felony, Kidnapping first in Alabama is punishable by 10 years to life in prison and is covered by Alabama Code 13A-6-43.

Kidnapping Second Degree

Kidnapping 2nd outlaws the abduction of another person under circumstances that are not considered Kidnapping 1st.

As a Class B felony, it is punishable by up to 20 years in prison and is governed by Alabama Code 13A-6-44.

We most often see kidnapping II charges in child custody disputes where the custodial parent demands kidnapping charges against the other parent or grandparent who they claim took the minor child without permission.
