The charge of Unlawful Distribution of a Controlled Substance applies to the sale, furnishing and even the giving away of a controlled substance within the State of Alabama. This charge is often called UDCS as an abbreviation, and can cover activity to the action sale of cocaine, to simply sharing a needle of heroin to someone without expectation of any profit.

Distribution Punishment

While we don’t like to lose cases, the Defendant needs to know what they are facing if convicted of distribution. UDCS is a Class B felony in Alabama making it punishable by up to 20 years in prison even if you’ve never been in trouble. There are also enhancements that apply that typically make the minimum punishment 12 years even for a first offense. Thankfully, the Alabama Sentencing Guidelines has reduced the punishment for UDCS cases effective 2013. However, there are still stiff punishments for those convicted of distribution.
