Alabama law recognizes three different degrees of Arson.

Arson in the First Degree

According to the Code of Alabama (1975) 13A-7-41, Arson I is when you intentionally set fire to a building while people are inside. This crime is a Class A felony subjecting the defendant to a sentence of up to life in prison.

Arson in the Second Degree

According to Code of Alabama (1975) 13A-7-42, Arson II is when you intentionally damage a building in which a third party has an interest by setting it on fire without their consent. This crime is a Class B felony subjecting the defendant to a sentence of up to 20 years in prison.

Arson in the Third Degree

According to Code of Alabama (1975) 13A-7-43, Arson III is when you recklessly causes damage to a building in which a third party has an interest by fire or explosion without their consent. This crime is a misdemeanor because it is not intentional.
